Terms of use

These Terms of Use (“ToU“) govern access to the site hebergeneve.com published by HEBERGENEVE SAS. They do not govern the conditions of rental of the furnished tourist accommodation, which are subject to separate Rental Terms (and, where applicable, the conditions of the Airbnb / Booking.com platforms when the booking is made there).

1. Purpose

The site aims to present the concierge services and properties managed by HEBERGENEVE SAS in the Pays de Gex, and to allow users:

  • To browse listings of properties available for short-term rental
  • To submit a booking request via the embedded Smoobu module or by direct contact
  • To request a quote for managing their property (owners)
  • To consult editorial content (guides, articles, news)

2. Acceptance

Simply visiting the site implies full acceptance of these ToU. Any person who does not accept these terms is invited to leave the site.

3. Site access

The site is accessible free of charge, 24 hours a day, 7 days a week, subject to maintenance operations or incidents beyond our control. HEBERGENEVE SAS cannot be held liable for any temporary unavailability.

4. Use of the site

The user undertakes to:

  • Provide accurate information when communicating via forms
  • Not use the site for fraudulent purposes, unauthorised commercial purposes, or in a way likely to infringe third-party rights
  • Not attempt to access protected areas of the site without authorisation
  • Not collect data automatically (scraping, robots) without prior written agreement
  • Not introduce malicious code (viruses, Trojan horses, etc.)

5. Smoobu booking module

The booking module embedded on property pages is provided by Smoobu GmbH, a third-party company. Bookings made through this module are subject to the general terms of sale applicable between HEBERGENEVE SAS (or, where applicable, the owner-landlord represented by HEBERGENEVE) and the traveller. These terms are presented before booking confirmation.

6. Links to third-party sites

The site may contain links to external sites (Airbnb, Booking.com, Smoobu, Google Maps, etc.). HEBERGENEVE SAS exercises no control over these sites and disclaims any responsibility for their content, privacy policy or practices.

7. Intellectual property

8. Liability

The information presented on the site (prices, availability, property characteristics) is provided for information only and may change. Only the written confirmation of a booking commits HEBERGENEVE SAS contractually. No liability is incurred for the direct or indirect consequences of using the site, except in case of gross negligence or serious breach.

9. Personal data protection

Data collected on the site is subject to a dedicated policy: see the privacy policy.

10. Modification of the ToU

HEBERGENEVE SAS reserves the right to modify these ToU at any time. The applicable version is the one in force on the date of the visit, as dated in the footer.

11. Applicable law

These ToU are governed by French law. Any dispute relating to their interpretation or performance falls under the exclusive jurisdiction of French courts (see the “Jurisdiction” article in the legal notice).
