HEBERGENEVE SAS is not subject to VAT under articles 293 B et seq. of the French General Tax Code (small-business exemption regime). It therefore does not collect VAT on its sales and does not show VAT on its invoices (legal mention “VAT not applicable, art. 293 B of the French Tax Code”). The company does not currently hold an intra-EU VAT number, its intra-EU acquisitions of services remaining below the 10,000 euros annual derogation threshold provided for in article 256 bis I 2° bis of the French General Tax Code. An intra-EU VAT registration will be requested from the Corporate Tax Office as soon as the threshold is approached.

4. Activity carried out and legal qualification

HEBERGENEVE SAS’ main activity is short-term rental of furnished tourist accommodation across the Pays de Gex and its immediate surroundings (articles L.324-1-1 and D.324-1 of the French Tourism Code).

It also offers owners in the area two legally distinct formats for managing their properties:

  • Commercial furnished sub-letting contract: HEBERGENEVE leases the property from the owner-landlord and then sub-lets it as short-term furnished tourist accommodation to travellers, on a regular basis and on its own behalf. HEBERGENEVE is then the official landlord, collects all rents in full, collects and pays the tourist tax, and bears the related tax and administrative obligations (tourist rental declaration, town hall registration, local economic contribution and, where applicable, VAT).
  • Concierge services contract: HEBERGENEVE provides the owner, as an independent B2B service provider, with a range of services (creation and maintenance of multi-platform listings, dynamic pricing, traveller communication, check-in / check-out coordination, cleaning and linen, routine maintenance, monthly reporting). The owner remains the official landlord and the only party to the rental agreement entered into with the traveller; payments from travellers are collected directly via the Stripe Connect solution (direct charge mode, the owner being merchant of record); the owner collects and pays the tourist tax themselves to the Pays de Gex community. HEBERGENEVE collects no funds on the owner’s behalf and invoices its services under a separate B2B contract; its remuneration takes the form of a commission automatically deducted by Stripe (application fee) on each booking and re-invoiced to the owner monthly.

This second format does not fall within the scope of Act no. 70-9 of 2 January 1970 (the Hoguet Act), since HEBERGENEVE (i) does not act as a real-estate agent, (ii) does not handle funds on behalf of others, traveller payments being credited directly to the owner’s bank account via Stripe Connect, and (iii) does not represent the owner in concluding or terminating rental agreements. It also does not fall under article L.211-1 of the French Tourism Code regarding tour operators, since HEBERGENEVE acts as a B2B service provider to the owner and not as a travel intermediary towards the end traveller.

5. Local registrations and the Le Meur Act

Act no. 2024-1039 of 19 November 2024 (the Le Meur Act) and its implementing decree no. 2025-133 of 13 February 2025 establish a national online registration service for furnished tourist rentals, due to come into force on 20 May 2026. From that date, every property let as furnished tourist accommodation must hold a national registration number, displayed on all online listings, under penalty of administrative fines of up to 15,000 euros per property (art. L.324-2-1 French Tourism Code).

As of the update date of this page (24 April 2026), the Pays de Gex municipalities concerned by properties managed by HEBERGENEVE have not yet opened their local online services. Registration steps will be carried out from 20 May 2026: by HEBERGENEVE for properties under commercial sub-letting, by the owner-landlord for properties under concierge services contract. Registration numbers will be published on each property page as soon as assigned.

The tourist tax is, depending on the legal regime applicable to the property:

  • Collected by HEBERGENEVE and then paid to the Pays de Gex community for properties under commercial sub-letting — HEBERGENEVE then being the host within the meaning of article L.2333-33 of the French General Code of Local Authorities;
  • Collected and paid directly by the owner-landlord for properties under concierge services contract, in accordance with article L.2333-26 of the French General Code of Local Authorities — the owner remaining the official host within the meaning of art. L.2333-33 CGCT.

6. Professional insurance

HEBERGENEVE SAS is insured under a Multi-risk Professional contract taken out with:

This cover is supplemented by the protections provided by partner platforms when the booking originates there: Airbnb AirCover for Hosts and Booking.com Host Protection.

7. Intellectual property

All site content (texts, photographs, logos, brand, graphics, source code) is the exclusive property of HEBERGENEVE SAS or its partners, and is protected by the provisions of the French Intellectual Property Code.

Any reproduction, representation, modification or use, even partial, without prior written authorisation, is strictly prohibited and would constitute infringement punishable under articles L.335-2 et seq. of the French Intellectual Property Code.

Property photographs are the property of HEBERGENEVE SAS or, for properties under concierge services contract, of the owner-landlord who has granted use to HEBERGENEVE through a written assignment compliant with article L.131-3 of the French Intellectual Property Code, within the framework of the concierge services contract. They may be reused by partner platforms (Airbnb, Booking.com) strictly for the purpose of distributing our listings.

8. Personal data

HEBERGENEVE SAS acts as data controller for personal data collected on the site as well as in the context of its short-term rental activity. Detailed information on collection, purposes, retention periods, recipients and rights of data subjects is set out in our privacy policy.

In accordance with article 30 of Regulation (EU) 2016/679 (GDPR), a record of processing activities is maintained and available to the CNIL on request. For any question regarding your personal data or the exercise of your rights: rgpd@hebergeneve.com.

9. Cookies

The site uses technical cookies necessary for its proper operation and anonymised audience-measurement cookies. No advertising or third-party tracking cookies are placed without explicit consent. See the cookies policy.

10. Complaints, applicable law and jurisdiction

These legal notices, as well as the rental terms and contractual relationships with travellers, are governed by French law.

Any complaint must be sent in writing to contact@hebergeneve.com. HEBERGENEVE SAS undertakes to provide a reasoned response within a reasonable timeframe.

Failing amicable resolution, disputes are submitted to the competent courts under the following conditions:

  • For travellers acting as consumers, jurisdiction is determined under the consumer-law rules: the consumer may, at their choice, refer the matter either to one of the courts territorially competent under the French Code of Civil Procedure, or to the court of the place where they were domiciled at the time the contract was concluded or where the harmful event occurred (articles R.631-3 and R.631-4 of the French Consumer Code).
  • For B2B relations between HEBERGENEVE SAS and its partners (owners, suppliers), exclusive jurisdiction is granted to the Bourg-en-Bresse Commercial Court, unless otherwise provided in the contract.
